1. Introduction
Welcome to NeutralAccessCommons ("we," "us," or "our"). These Terms & Conditions ("Terms") manage your interaction with our yacht charter service and our website at neutralaccesscommons.sbs, provided by NeutralAccessCommons.
By securing a charter or utilizing our Service, you consent to adhere to these Terms. If you do not accept any section of these terms, you are prohibited from using the Service.
2. Service Overview
NeutralAccessCommons offers an array of yacht charter services that include:
- Yacht charters for a day
- Evening boat trips
- Business outings
- Exclusive gatherings
- Extended yacht vacations
Service availability depends on scheduling and climate considerations and may be modified or ceased upon our discretion.
3. Booking and Reservations
3.1 Booking Process
For charter booking, you are required to:
- Be a minimum of 18 years old
- Provide valid and comprehensive details
- Make a deposit as stated in the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Your reservation is confirmed only with the acknowledgement of the payment and our formal confirmation. Service provision is at our discretion and may be declined to any individual.
3.3 Availability
Charter services are conditioned on the availability of the vessel and conducive weather. Every attempt will be made to accommodate your preferred schedule.
4. Payment Terms
4.1 Pricing
All prices are set in € and encompass all relevant taxes unless specified. Prices are subject to modification without prior notice.
4.2 Payment Schedule
- Deposit: Payment of 50% of the complete charter cost is required at time of reservation
- Balance: Payment due 48 hours prior to the charter departure
- Any additional costs: Payable at the end of the charter experience
4.3 Payment Methods
Payments are accepted through credit cards, bank wires, and certified cheques. Our payment processes are safeguarded with encryption.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours prior to departure: Entire refund excluding transaction fees
- Between 24 to 72 hours before departure: Refunded 50% of the total price
- Within less than 24 hours of departure: No refund available
5.2 Weather Cancellations
If the weather conditions are considered dangerous by our captain, we will propose:
- Rescheduling your charter to an alternative available date with no additional charges
- Issuing a complete refund if it's not feasible to reschedule
5.3 Mechanical Issues
If there's an issue with the yacht assigned to you, we aim to provide an adequate replacement. If a substitute is not available, we will issue a full reimbursement.
6. Safety and Conduct
6.1 Safety Requirements
All guests are expected to:
- Obey all directions provided by the crew
- Utilize safety gear when mandated
- Disclose any health conditions affecting safety
- Stay within the assigned areas on the yacht
6.2 Prohibited Items
Certain items are forbidden on board:
- Glassware
- Illegal substances
- Weapons or firearms
- Excessive quantities of beverages (beyond reasonable consumption)
- Pets (unless previously approved)
6.3 Conduct
Guests must behave respectfully. Any charter may be concluded prematurely without a refund if guests' actions constitute a safety risk or if they disrupt the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Our liability is restricted to the sum paid for the charter and does not cover:
- Injuries due to guests' misconduct
- Personal possessions lost or damaged
- Indirect, consequential or punishment charges
- Delays from weather or events out of our control
7.2 Insurance Coverage
Comprehensive marine insurance that encompasses our vessels and operations is actively maintained. It is the responsibility of guests to ensure their personal travel and belongings.
7.3 Assumption of Risk
Engaging in our yacht services suggests acceptance of the inherent risks associated with maritime activities, and you agree to take responsibility for your safety and actions.
8. Modifications and Itinerary Changes
We hold the right to adjust itineraries, pathways, or schedules due to weather implications, safety protocols, or operational demands. Our goal is to provide experiences of comparable quality.
9. Force Majeure
We are exempt from responsibility for interruptions, cancellations or changes resulting from situations beyond our influence, which can include:
- Extreme weather and climate conditions
- Natural catastrophes
- Legal directives
- Harbor closures
- Vehicular breakdowns
10. Privacy and Data Protection
Your private data is treated in line with our Privacy Policy. By engaging with our services, you agree that your information may be utilized as outlined in the Privacy Policy.
11. Intellectual Property
All materials on our website, which includes text, visuals, marks, and images, are defended by copyright and trademark regulations. No production, distribution, or derivative creation is permitted without explicit consent.
12. Governing Law
The established Terms are subject to the laws of Monaco. Disputes will be settled in the courts situated in Monaco, Monaco.
13. Changes to Terms
We retain the authority to alter these Terms whenever necessary. Any changes will be posted on our platform with an updated revision date. Continuous usage of our services implies acceptance of the revised terms.
